Terms of Service for CppModel

1. Introduction

This Terms of Service (“Agreement”) governs the use of CppModel (the “Service”), operated by Control Edge AB (“we,” “us,” “our”). By accessing or using the Service, you (“User,” “you,” “your”) agree to be bound by this Agreement. If you do not agree to these terms, you must not use the Service.

2. Definitions

• Service: The cloud-based workspace that allows users to explore and upload simulation data via the Service's client libraries and web interface.
• User Account: The account registered with the Service, associated with the user's access and usage.
• Simulation: Any executable compiled by the user including Service's libraries for the purpose of testing or analysis via the Service.
• Personal Account: An account type that allows users to explore simulation results but does not provide the ability to share this data.
• Organization Account: An account type that allows for the creation of an organization workspace and the invitation of multiple users to collaborate.

3. Eligibility

You must be at least 18 years old to use this Service. By registering, you represent that you meet this eligibility requirement.

4. User Accounts

• You are required to create an account to use the Service.
• Personal Accounts allow users to explore simulation results but do not provide the ability to share this data.
• Organization Accounts allow users to create an organization workspace and invite additional members.
• You are responsible for maintaining the confidentiality of your account login information.
• You are responsible for all activities that occur under your account, whether authorized by you or not.

5. Use of the Service

• Workspace and Containers: A Linux container is created for each organization (or user when a Personal license is selected), which is restricted from any inbound and outbound traffic except the traffic necessary for the Service to function.
• Prohibited Use: You agree not to use the Service for illegal activities, including but not limited to running unauthorized, malicious, or harmful code. Any suspicion of illegal activity will result in immediate termination of your account, with no refund.

6. Payments and Billing

• Recurring Payments: Payments for the Service are billed on a monthly, recurring basis.
• Cancellation Policy: You can cancel your subscription at any time. Upon cancellation, your account will remain active until the end of the current billing period.
• No Refunds: Once payments are made, they are non-refundable. This applies in cases of account termination due to a breach of this Agreement, including illegal activity.

7. Termination of Service

• Termination by Us: We reserve the right to terminate your account immediately, without notice, if illegal activity is suspected, or if you breach any term of this Agreement.
• Termination by You: You may terminate your account at any time by canceling your subscription. Access will remain available until the paid period ends.

8. Privacy and Data Collection

We collect and process your personal information in accordance with our Privacy Policy. By using the Service, you agree to the collection and use of your information as outlined in the Privacy Policy.

9. Content Ownership and Licensing

• Your Content: You retain ownership of any content you upload to the Service, including simulations and test results. However, by uploading content, you grant us a limited license to store and process that content for the purpose of providing the Service.
• Our Content: All Service components, including software, documentation, and any associated intellectual property, remain the exclusive property of Control Edge AB.

10. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis without any warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.

11. Limitation of Liability

In no event shall Control Edge AB be liable for any indirect, incidental, consequential, or punitive damages arising out of your use or inability to use the Service, even if we have been advised of the possibility of such damages.

12. Indemnification

You agree to indemnify and hold Control Edge AB, its affiliates, officers, and employees harmless from any claims, damages, or liabilities arising out of your use of the Service, including illegal activity or violation of this Agreement.

13. Governing Law

This Agreement shall be governed by the laws of Sweden, without regard to its conflict of law provisions.

14. Modifications

We reserve the right to modify or update these terms at any time. You will be notified of any significant changes. Continued use of the Service after any changes indicates your acceptance of the new terms.
